Texas State Penalty Determinations

Under state law, the severity of your penalty will depend on your criminal history, what drug or controlled substances were seized, how much was seized, and the reasons for the seizure. Under Texas law, there are four penalty groups setting out the range of punishments for each drug crime. For example, if you are charged with marijuana possession or are facing possession of meth charges, your penalty may be less than if you were in possession of heroin.

At certain levels or quantities, the government can allege that you had intent to distribute or manufacture, which will enhance the penalty range substantially. Other factors may enhance penalties, including selling or possessing drugs in a drug-free zone such as at schools, day cares, playgrounds or churches. The government can make allegations if you are stopped within 1000 feet of a school, and this may lead to the enhancement of your punishment.

We Can Represent You In Any Of The Following Drug-Related Issues:

  • Drug possession
  • Drug distribution
  • Charges involving marijuana, heroin, cocaine and methamphetamine
  • Transporting drugs and drug trafficking
  • Cannabis drug cultivation
  • Seizure of property
  • Civil forfeiture
  • Manufacture of controlled substances such as methamphetamine or synthetic drugs

Search Warrants and Seizure of Property

Most drug cases turn on the ability of law enforcement officials to search and seize property linked to the crime. This property may be drugs or paraphernalia, but could also include products for manufacture of drugs. There are very strict procedures that law enforcement officials must follow if they are going to search your person, your car, your home or your land. If you were illegally searched, we will challenge the use of that evidence in order to defeat the case the government has built against you.
