Texas Penalty Determinations

Under state law, the severity of your penalty will depend on your criminal history, what drug or controlled substances were seized, how much was seized, and the reasons for the seizure. Under Texas law, there are four penalty groups setting out the range of punishments for each drug crime. For example, if you are charged with marijuana possession, your penalty may be less than if you were in possession of a THC concentrate.

At certain levels or quantities, the government can allege that you had intent to distribute or manufacture, which will enhance the penalty range substantially. Other factors may enhance penalties, including selling or possessing drugs in a drug-free zone such as at schools, day cares, playgrounds or churches. The government can make allegations if you are stopped within 1000 feet of a school, and this may lead to the enhancement of your punishment.
